Attorney Lynsey Barron Calls Criminal Charges Against Suspended Clayton County Sheriff Unconstitutional

In an interview with Fox 5 Atlanta, defense lawyer Lynsey Barron says the criminal charges against suspended Clayton County Sheriff Victor Hill violate Hill’s due process rights because "the Constitution forbids prosecution of anyone who basically doesn't have notice that what they are doing is criminal." The indictment charges Hill with civil rights violations for his alleged misuse of a restraint chair at the Clayton County jail. But according to Barron, the law does not “clearly establish” that Hill’s conduct rose to the level of excessive force and therefore he did not have fair warning that he could face criminal charges. Barron filed a motion to dismiss the criminal case against Hill on July 12, 2021.
