iHeart Prevails as Georgia High Court Rules Internet Streaming of Pre1972 Recordings Isn’t Piracy

March 27, 2017

As reported in a Daily Report news article, Miller & Martin attorneys Danny Griffin and Michael Kohler served as local counsel representing the media company in the iHeart v. Sheridan lawsuit, which stemmed from a federal civil RICO class action suit and alleged that iHeart’s intranet radio streaming violated piracy law.

In an unanimous opinion handed down March 20, 2017, the Georgia Supreme Court ruled that media companies that stream music recordings made prior to 1972 over the internet without paying royalties or licensing fees are not violating Georgia's criminal record piracy law.

iHeart is also represented by Latham & Watkins attorneys Andrew Gass and James Lynch in San Francisco and former U.S. Solicitor General Gregory Garre and Jonathan Ellis in Washington.
