    Andrew Whitten is a litigation associate who represents public and private entities both large and small, as well as individuals, in state and federal courts and in arbitration. He has advised clients across industries and sectors, including construction and healthcare, on a wide range of litigation and dispute resolution matters. His experience includes breach of contract disputes, construction defect and delay claims, healthcare litigation, and employment-related lawsuits such as discrimination, sexual harassment, workplace leave, and accommodation claims. Andrew also has experience representing clients before various regulatory bodies. In addition to his litigation practice, Andrew is experienced in contract drafting and negotiation.

    Andrew earned his law degree cum laude from Belmont University College of Law. While in law school, he focused on the healthcare industry and earned a certificate in Health Law. He also served as Editor-in-Chief of one of the school’s journals and as Vice President of his school's chapter of the American Constitution Society.

  • Experience

    • Represented national construction company in multi-million-dollar construction defect dispute.
    • Represented physician practice groups with regulatory compliance concerns.
    • Represented large, national entities, including Fortune 500 companies, in various complex commercial disputes.
    • Represented insurance companies in providing coverage opinions in contentious disputes over commercial insurance policies.
    • Represented state and local entities in negotiations and contracting for multi-million-dollar federally funded projects. 
    • Represented a variety of public entities both large and small, including public utility boards, hospital districts, and more. 
    • Secured the dismissal of lawsuit for a Tennessee health care provider as a result of a motion to dismiss based on novel arguments related to the procedural requirements of the Tennessee Health Care Liability Act.
    • Led discovery strategy for a complex arbitration proceeding involving geotechnical issues in a construction defect dispute. 
    • Obtained complete dismissal of a lawsuit for a major construction company through a pre-answer motion to dismiss based on complicated procedural arguments.
    • Facilitated numerous construction projects from initial bids through completion.
