    Laura Ashby is an experienced litigator whose practice concentrates on business, intellectual property and tort litigation. She focuses on providing cost-effective solutions to a wide range of matters, from breach-of-contract cases to complex consumer class actions. She also represents a wide variety of clients in different sectors, including banking, telecommunications, consumer products and pharmaceuticals. Her subject matter experience includes copyright, trademark and patent infringement; class actions (false advertising, Telephone Consumer Protection Act and Fair Credit Reporting Act); consumer protection; product liability; trade secrets; restrictive covenants; and contracts.

    Laura has substantial intellectual property experience, and in addition to counseling her clients on IP matters, she has litigated before federal and state courts involving claims of copyright infringement, patent infringement, trademark and trade dress infringement, trademark dilution, unfair competition and false advertising.

    She has a theater background, so she enjoys trying cases and has extensive trial and litigation experience, including second chair in a bench trial on a multi-million dollar breach-of-contract dispute and first chair in hearings on temporary restraining orders and preliminary injunctions and motions hearings. But she also prides herself on keeping costs down for her clients and winning cases on dispositive motions. Her litigation experience also includes specialization in eDiscovery and ESI, and she is a frequent speaker at conferences on eDiscovery and eDiscovery amendments to the Federal Rules of Civil Procedures. Laura is also well-versed in alternative dispute resolution and has handled arbitrations and mediations. She is on the Board of Directors of the Atlanta International Arbitration Society.

    Laura has achieved significant and cost-effective victories for her clients:

    • Obtained favorable and cost-effective multi-million dollar pre-litigation settlements of complex banking claims.
      •  Briefed certified question regarding the business judgment rule before the Supreme Court of Georgia.
    • Represented large manufacturer of consumer products in class action lawsuits across the country.
      • Obtained dismissal of a California consumer class action.
      • Defeated class certification of a purported Illinois consumer class action.
      • Decisions reported in Product Liability Law 360 and Drug & Device Law.
    • Successfully defended state university in copyright case of national significance under fair use defense, including drafting the copyright policy for the university system.
    • Obtained order preventing disclosure of financing company’s trade secrets.
    • Obtained order on ESI protocol for significant amounts of data maintained by banking client, shifting costs to opposing party.
    • Summary dismissal of ERISA claims against supermarket chain.
    • Dismissal of Fair Credit Reporting Act and Fair Debt Collection Practices Act claims against telecommunications company.
