Miller & Martin Represents Hi-Tech Pharmaceuticals in False Advertising Case
December 04, 2018
Miller & Martin has successfully helped Hi-Tech Pharmaceuticals revive its false-advertising lawsuit against HBS International Corp. concerning the allegedly misleading labeling of protein-powder mix. In a December 4, 2018 ruling, the U.S. Court of Appeals for the Eleventh Circuit partially reversed a July 2017 decision by the U.S. District Court for the Northern District of Georgia, which had dismissed Hi-Tech’s lawsuit brought under the Lanham Act and a Georgia consumer-protection statute.
Hi-Tech Pharmaceuticals was represented by David M. Barnes and Robert F. Parsley of Miller & Martin, and Charles Ronald Bridgers and Edmund J. Novotny Jr. of DeLong Caldwell Bridgers & Fitzpatrick LLC.
