    David is a seasoned commercial litigator with expertise in all areas of dispute resolution and trial, with a particular emphasis in intellectual property litigation. David represents his clients in state, federal, and appellate courts throughout the country, achieving successful outcomes by identifying pragmatic and creative solutions to complex issues while minimizing business disruptions and expense.  

    David has handled a myriad of business disputes, including issues relating to contracts, copyrights, employment agreements, non-competition agreements, non-disclosure agreements, patents, trademarks, and trade secrets. Further, with a background in engineering, David is comfortable leading cases that delve into complex technologies, having previously handled cases relating to advanced cleaning systems, automotive technologies, cloud-based SaaS systems and services, infant and consumer products, fuel blending systems, high-definition display technologies, life sciences, medical devices and systems, packet-switched protocols and networks, payment systems and networks, semiconductor designs, telecommunication protocols, and wireless devices and networks.

    David is registered to practice before the United States Patent and Trademark Office, and in this capacity, has assisted companies with identifying, protecting, defending, and monetizing their patents, trademarks, copyrights, and trade secrets, including through cases before the Patent Trial and Appeal Board (PTAB) and the Trademark Trial and Appeal Board (TTAB).

  • Experience

    • Representation of automotive-related client in patent litigation through jury trial and appeal in the District of Delaware and before the Federal Circuit Court of Appeals.
    • Defense verdict in jury trial between competitors in cloud-based SaaS industry pertaining to allegations of trade secret misappropriation, breach of contracts, and breach of non-competition agreements.
    • Successful resolution of patent litigations in federal courts across the country, including the Eastern District of Texas and District of Delaware, relating to cases filed by non-practicing entities against product suppliers and customers.
    • Institution of inter partes review before Patent Trial and Appeal Board proceeding on behalf of medical device maker resulting in favorable settlement with market competitor.
    • Successful defense of patent claims in inter partes review before the PTAB relating to medical diagnosis systems and methods.
    • Successful invalidation of electronic device patents on behalf of competitor through use of ex parte reexamination proceeding before the United States Patent and Trademark Office.
    • Successful opposition proceedings before the Trademark Trial and Appeal Board on behalf of registrants and trademark owners.
    • Successful representation of copyright owner in the Northern District of Georgia pertaining to unauthorized use of original materials by third-party for recruitment efforts.
    • Successful defense of a major telecommunications company in patent litigation in the Eastern District of Texas concerning digital data networks.
    • Plaintiff verdict and award of damages for a financial processing entity against a competitor in the Western District of Wisconsin.
    • Successful defense of a Fortune 100 electronics device manufacturer in patent litigation in the Northern District of Georgia concerning high-definition display technologies.
    • Complete defense victory and finding of invalidity in the Northern District of Georgia in patent litigation pertaining to cleaning systems and methods.
    • Worldwide patent portfolio management for a mobile technology company.
    • Successful development of patent portfolio for company in the advertising sector leading to advantageous corporate acquisition.
